(Surat Keputusan Ketua Mahkamah Agung Republik Indonesia Nomor : 076/KMA/SK/VI/2009 Tentang Pedoman Pelaksanaan Penanganan Pengaduan Di Lingkungan Lembaga Peradilan)

  1. Disampaikan secara Tertulis
    1. Pengaduan hanya dapat diterima dan ditangani oleh Mahkamah Agung, Pengadilan Tingkat Banding dan Pengadilan Tingkat Pertama apabila disampaikan secara tertulis oleh Pelapor;
    2. Pelapor dianjurkan untuk menggunakan fonnulir khusus untuk menyampaikan pengaduannya, baik dalam bentuk cetak maupun elektronik di situs resmi Mahkamah Agung. Meskipun demikian. pengaduan yang tidak menggunakan formulir khusus tersebut tetap akan diterima dapat ditindaklanjuti;
    3. Dalam hal Pelapor memiliki kesulitan untuk membaca dan menulis, petugas Mahkamah Agung atau Pengadilan akan membantu menuangkan Pengaduan yang ingin disampaikan Pelapor secara tertulis dalam formulir khusus pengaduan.

  1. Menyebutkan Informasi yang jelas
  1. Untuk mempermudah penanganan dan tindak lanjut terhadap pengaduan yang disampaikan, Pelapor diharapkan dapat menyebutkan secara jelas informasi mengenai:
    1. Identitas Aparat yang dilaporkan, termasuk jabatan, serta satuan kerja atau pengadilan tempat Terlapor bertugas;
    2. Perbuatan yang dilaporkan;
    3. Nomor perkara, apabila perbuatan yang diadukan berkaitan dengan pemeriksaan suatu perkara; dan
    4. Menyertakan bukti atau keterangan yang dapat mendukung pengaduan yang disampaikan. Bukti atau keterangan ini termasuk nama, alamat dan nomor kontak pihak lain yang dapat dimintai keterangan lebih lanjut untuk memperkuat pengaduan Pelapor.
  2. Pelapor sedapat mungkin diharuskan untuk mencantumkan identitasnya. Namun demikian selama informasi dalam pengaduan yang disampaikan benar dan memiliki dasar yang kuat, pengaduan yang tidak mencantumkan identitas akan tetap ditindaklanjuti oleh Mahkamah Agung.
  1. Tata Cara Pengiriman
  1. Pengaduan ditujukan kepada:
  1. Ketua atau Wakil Ketua pada Pengadilan Tingkat Pertama atau Pengadilan Tingkat Banding di mana Terlapor bertugas; atau
  2. Ketua Wakil Ketua Mahkamah Agung Bidang Non Yudisial, atau Ketua Muda Pengawasan dengan tembusan kepada Kepala Badan Pengawasan.
  1. Apabila pengaduan dikirimkan melalui pos dalam amplop tertutup, maka harus disebutkan secara jelas bahwa isi amplop tersebut adalah pengaduan dengan menuliskan kata “PENGADUAN pada Pengadilan” pada bagian kiri atas muka amplop tersebut.
